A thorough review of DAPL\u2019s impact on public health and a detailed Environmental Impact Statement should have been prepared before DAPL went online.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">On January 26, 2021, a three-judge panel of the D.C. Circuit Court of Appeals upheld a lower court ruling that an EIS must be prepared for DAPL. Energy Transfer LLP, DAPL\u2019s operator, appealed that decision to the U.S. Supreme Court. Yesterday, the High Court denied review, effectively putting an end to the current litigation.<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">\u201cThe ball is now in the U.S. Army Corps of Engineers\u2019 court,\u201d Alkire explains. \u201cThe Corps is obligated to prepare a comprehensive Environmental Impact Statement detailing the true threat that DAPL poses to our land, our water and our people.\u201d<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">According to Alkire, in preparing the EIS, the Corps has not shown much interest in Standing Rock\u2019s views of the pipeline\u2019s environmental impacts. \u201cStanding Rock is the community that will be most affected by an oil spill in the Missouri River, but the Corps has limited our input,\u201d she says. \u201cImportant concerns of our Tribe, such as DAPL\u2019s inadequate emergency response plans, are being totally ignored by the Army Corps of Engineers.\u201d According to Alkire, that puts Tribal first responders at unnecessary risk.<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">For these reasons, on January 20, Standing Rock withdrew as a cooperating agency in the Corps\u2019 process of developing the EIS. \u201cThe Corps refuses to take our concerns seriously,\u201d Alkire says.\u00a0<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">Alkire \u2014 the first woman elected to lead the Standing Rock Sioux Tribe in more than six decades \u2014 has scheduled a meeting on March 2 at Standing Rock with Michael Connor, Assistant Secretary of the Army, to discuss the Tribe\u2019s concerns with the EIS process.<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">Doug Crow Ghost, administrator of Standing Rock\u2019s Water Resources Department, continues to be concerned with the low water elevations of Lake Oahe and the impacts if an oil spill were to happen today. \u201cThe Corps\u2019 water releases at Oahe Dam have lowered river levels at Standing Rock by 12 feet below normal,\u201d Crow Ghost says. \u201cThis puts our communities at further risk.\u201d<\/span><\/p>\n<p><span style=\"font-size: 11.0pt\">The Dakota Access pipeline passes directly underneath Lake Oahe, a reservoir directly adjacent to the Standing Rock Sioux Tribe\u2019s Reservation, which supplies most of the Tribe\u2019s fresh drinking water and serves as hunting and fishing grounds for many Standing Rock residents. \u201cWith water this low, DAPL should be shut down,\u201d Crow Ghost says. \u201cToday, our prayers for clean water have been heard.
