Yet, despite its genocidal overtones, Coulter\u2019s post remains protected under the U.S. Constitution.<\/p>\n<p> \u201cCelebrating genocide against tribal nations crosses every moral line,\u201d said Mark Macarro, president of the National Congress of American Indians (NCAI). \u201cCareless comments like this glorify the darkest chapters of U.S. history and actively endanger Native peoples\u2019 lives today. We will not sit silently at attempts to normalize this abhorrent behavior.\u201d<\/p>\n<div id=\"attachment_37817\" style=\"width: 445px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/files\/2025\/07\/1p2.jpg\"><img decoding=\"async\" aria-describedby=\"caption-attachment-37817\" class=\"wp-image-37817 size-large\" src=\"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/files\/2025\/07\/1p2.jpg\" alt=\"Ann Coulter is facing backlash for a violent remark about Native Americans.\" width=\"435\" \/><\/a><\/p>\n<p id=\"caption-attachment-37817\" class=\"wp-caption-text\">Ann Coulter is facing backlash for a violent remark about Native Americans.<\/p>\n<\/div>\n<p>Cherokee Nation Principal Chief Chuck Hoskin Jr. called the tweet \u201cbeyond abhorrent\u201d and said it should be repudiated by leaders of all political affiliations. \u201cThis is not just offensive. This is language that echoes genocide and implicitly encourages it,\u201d he said. \u201cThe country frequently seems on the verge of political violence. Coulter\u2019s post implicitly encourages it.\u201d<\/p>\n<p>John EchoHawk, executive director of the Native American Rights Fund, described the tweet as \u201cignorant, immoral, and unacceptable,\u201d noting that such statements help normalize dehumanization. \u201cThis is a moment for all Americans to say: enough.\u201d<\/p>\n<p>For Cherokee journalist and advocate Rebecca Nagle, Coulter\u2019s tweet is just another chapter in a long, ugly narrative. \u201cIt\u2019s all just to get likes, to rev up her base at the expense of Indigenous lives and dignity,\u201d Nagle said. \u201cShe\u2019s celebrating what our people endured and survived. That\u2019s why it cuts so deep.\u201d<\/p>\n<p>Tasha Mousseau, vice president of the Wichita and Affiliated Tribes, echoed that sentiment. \u201cIn Indian Country, we are still here, thriving, and we are our ancestors\u2019 wildest dreams,\u201d she said. \u201cBut remarks like this are a reminder of the violence our people have survived\u2014 and still face.\u201d<\/p>\n<p>The Sooner State Party, a new political movement in Oklahoma, issued a statement denouncing Coulter\u2019s post as \u201cThird Reich beliefs\u201d and \u201cabhorrent bigotry.\u201d They called for a complete boycott of Coulter\u2019s media and book appearances, saying, \u201cIn Oklahoma, we rise against the repugnant mindset of hatred displayed by Coulter.\u201d<\/p>\n<p>The pain is amplified by history. Coulter\u2019s words conjure up a long line of American presidents who expressed hostility toward Native people.<\/p>\n<p>From George Washington comparing Native Americans to \u201cbeasts of prey,\u201d to Thomas Jefferson\u2019s call for extermination or removal, to Andrew Jackson\u2019s open disdain, and Theodore Roosevelt\u2019s infamous declaration that \u201cI don\u2019t go so far as to think the only good Indians are the dead Indians, but I believe nine out of every 10 are, and I shouldn\u2019t like to inquire too closely into the 10th.\u201d<\/p>\n<p>The words of past presidents often moved beyond rhetoric and into law, laying the foundation for policies of genocide, relocation, and cultural destruction. For many Native people, Coulter\u2019s tweet felt less like an outlier and more like a continuation.<\/p>\n<p>Though X initially placed a content warning on Coulter\u2019s post, it remained visible for over 24 hours. As of this writing, she has not apologized or retracted her words. Her post has been shared more than a million times.<\/p>\n<p>NCAI and other Native organizations have called on X to remove the post entirely and ban Coulter from the platform. So far, there has been no response from X\u2019s owner, Elon Musk, but it is very likely Musk will not take down such an offensive remark as he has previously stated, \u201cIf we lose freedom of speech, it\u2019s never coming back.\u201d<\/p>\n<p>And that\u2019s the paradox. However vicious, however vile, Coulter\u2019s words fall under the protection of the First Amendment.<\/p>\n<p>\u201cThere is no hate speech exception to the First Amendment,\u201d says constitutional law scholar Erwin Chemerinsky. \u201cThe government cannot prohibit speech simply because it is offensive, hateful, or even deeply disturbing.\u201d<\/p>\n<p>Legal experts note that unless speech incites imminent violence or constitutes a true threat, it remains protected\u2014even if morally indefensible. Courts have consistently ruled in favor of protecting unpopular or outrageous speech, citing the \u201cmarketplace of ideas\u201d principle. As Justice Anthony Kennedy once wrote, \u201cInconvenience does not absolve the government of its obligation to tolerate speech.\u201d<\/p>\n<p>This principle isn\u2019t abstract. It is central to American democracy. As author Christopher Hitchens put it, \u201cThe right of others to free expression is part of my own. If someone\u2019s voice is silenced, then I am deprived of the right to hear.\u201d <\/p>\n<p>Coulter\u2019s tweet is a test of that principle\u2014a reminder that the First Amendment is designed not for comfort, but for confrontation. For the battle of ideas to remain legitimate, even the repulsive must be allowed to speak, so long as it doesn\u2019t cross legal thresholds into incitement.<\/p>\n<p>Still, that doesn\u2019t mean such speech should go unanswered. Leaders from Indian Country and beyond have spoken loudly and clearly: Coulter\u2019s remark is not acceptable.<\/p>\n<p>\u201cWe are a people who have endured colonization, cultural genocide, and assimilation,\u201d said Hoskin. \u201cWe are still here. And we will not be silent.\u201d<\/p>\n<p>But in the final calculus, Coulter\u2019s words remain protected.<\/p>\n<p>The First Amendment is not a tool for the righteous\u2014it is a shield for the offensive. And however much it may sting to admit, scholars defending free speech argue even language that celebrates historical atrocity cannot, and must not, be outlawed simply for its indecency.<\/p>\n<p><span style=\"font-style: italic\">(James Giago Davies is an enrolled member of OST.
