{"id":9176,"date":"2019-08-17T18:18:12","date_gmt":"2019-08-17T23:18:12","guid":{"rendered":"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/sd-legislators-oppose-suggested-gun-protection-changes\/"},"modified":"2019-08-17T18:18:12","modified_gmt":"2019-08-17T23:18:12","slug":"sd-legislators-oppose-suggested-gun-protection-changes","status":"publish","type":"post","link":"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/sd-legislators-oppose-suggested-gun-protection-changes\/","title":{"rendered":"SD Legislators oppose suggested gun protection changes"},"content":{"rendered":"<div class=\"likebtn_container\" style=\"\"><!-- LikeBtn.com BEGIN --><span class=\"likebtn-wrapper\"  data-identifier=\"post_9176\"  data-site_id=\"63347fe36fd08b6c05de3d9e\"  data-dislike_enabled=\"false\"  data-icon_dislike_show=\"false\"  data-white_label=\"true\"  data-style=\"\"  data-unlike_allowed=\"\"  data-show_copyright=\"\"  data-item_url=\"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/sd-legislators-oppose-suggested-gun-protection-changes\/\"  data-item_title=\"SD Legislators oppose suggested gun protection changes\"  data-item_date=\"2019-08-17T18:18:12-05:00\"  data-engine=\"WordPress\"  data-plugin_v=\"2.6.59\"  data-prx=\"https:\/\/unitedresourceconnection.org\/cannon-ball-nd-58528\/wp-admin\/admin-ajax.php?action=likebtn_prx\"  data-event_handler=\"likebtn_eh\" ><\/span><!-- LikeBtn.com END --><\/div><p>PIERRE \u2013 Twenty-six\u00a0current and former South Dakota Republican legislators sent\u00a0letters to President Donald Trump, Senator John Thune, Senator Mike Rounds and Representative Dusty Johnson opposing proposed legislation to provide taxpayer funded grants to encourage\u00a0states to enact \u201cred\u00a0flag\u201d laws similar to those enacted by 17 states such as California, New York, Maryland, Illinois, New Jersey, Oregon, and others.<\/p>\n<p>\u201cRed flag\u201d laws refer to statutes that have been enacted in 17 states which allow\u00a0complaints to be made against persons that claim they may be a danger to themselves or others, and which seek to invoke gun seizures of any firearms the accused may own.\u00a0 Standards for issuing these ex-parte orders are minimal and judges err on the side of caution a reported 95% of the time in issuing orders for gun confiscations, often without\u00a0witnesses testifying, and with accused persons not allowed to defend themselves and unaware of such complaints until law enforcement shows up at their homes.\u00a0 Accused persons are effectively consider guilty until proven innocent under such procedures and proving oneself innocent and clearing your name under these actions is a very costly and timely struggle. There have been no evidence that any homicides or suicides have been prevented with\u00a0these \u201cred flag\u201d laws and opponents point out\u00a0that any \u201cfeel good\u201d hopes out of\u00a0such laws, pale in comparison to the constitutional rights abuses law-abiding citizens are being subjected to.<\/p>\n<p>Senator Stace Nelson (R-Fulton), a retired federal agent, agrees these mass shooting\u00a0incidents are horrifying and he agrees that changes need to be made to alleviate the conditions that\u00a0these murderers use to massacre\u00a0innocent people, but says \u201cred flag\u201d laws do not work, are counterproductive, threaten the rights of innocent law-abiding citizens, and do not address the core problems contributing to these mass murders. \u201cIt is impossible to predict or prevent someone from committing murder under these laws.\u00a0 If they are in fact intent on mass murder, there is no way to prevent them from using a knife, or a vehicle, or a myriad of other\u00a0lethal weapons.\u00a0 Congressman Thomas Massie (R-KY), and Senator John Thune (R-SD), both have common-sense pending legislation that actually address the conditions of law-abiding Americans being disarmed by petty bureaucracy and worthless \u201cgun-free zones.\u201d Their legislation builds on the success of states\u2019\u00a0 \u201cshall issue\u201d conceal carry &#038; \u201cconstitutional carry\u201d laws that experts believe have fueled the massive decline in violent and property crimes in the USA since 1993.\u201d<\/p>\n<p>Former Representative Elizabeth May (R-Kyle), a rancher and grocery store owner with deep roots in the Native American community, expressed grave concerns that such subjective laws are reminiscent of laws enacted in the South after the Civil\u00a0War against blacks and those historically imposed on\u00a0Native Americans. \u201cThere\u2019s a long history of discrimination when it comes to gun control.\u00a0 These \u201cred flag\u201d laws will result in a disproportionate impact and\u00a0economic burden on the poorest and most vulnerable people of our society who are the least able to defend or recover their rights.\u201d<\/p>\n<p>Native Sun News Publisher Tim Giago said, \u201cThe last mass murder in South Dakota took place at Wounded Knee. If nothing is done to regulate the sale of assault weapons and if no background checks are put into place immediately, there will be another mass murder somewhere in America if not in South Dakota and if so, I hope that every one of South Dakota\u2019s legislators are able to look at themselves in a mirror.\u201d<\/p>\n<p>Legislators believe that the more South Dakotans understand the realities of these \u201cred flag\u201d laws, the more they\u00a0will understand the real threat to their own\u00a0rights that such subjective laws\u00a0present.<\/p>\n<div class=\"likebtn_container\"
